General conditions of sale online and information for consumers
The following general conditions of sale apply to all purchases made using web pages belonging to OIP srl.
We reserve the right to change these conditions; if we do, the new conditions will take effect as soon as they are published on this website.
So, in order to avoid any misunderstandings, please read the following conditions of sale carefully every time you purchase any product using the OIP srl website.
1. ORDERS
Your orders will constitute binding offers under article 1329 of the Italian Civil Code. OIP srl reserves the right to accept them, wholly or in part, by sending you an email confirmation message.Sales contracts will be formally agreed when you receive the above confirmation message.

2. DELIVERY AND PAYMENT
The delivery timescales given are not binding. They simply indicate the period of time usually needed on average to deliver the products.
Subject to availability, goods will be shipped within the agreed timescales stated in the order confirmation, or at most seven working days after that.
OIP srl will not be liable in any circumstances for any delayed or failed deliveries due to unforeseeable events or to force majeure. In such cases, OIP srl may suspend or postpone the fulfilment of the order.
Payments must be made by credit card or bank transfer.
3. RIGHT OF WITHDRAWAL UNDER THE CONSUMER CODE (LEG. DECREE 206/05)
OIP srl guarantees that products supplied will be identical to those shown on the website. Products will have been stored in accordance with all applicable regulations until they are delivered to the location specified on the order.For packaged products, the producer is also responsible for the accuracy and completeness of the information on the packaging.Images on the website are provided to help customers recognise the products. Because producers may alter their packaging from time to time, the photos may not reflect the exact appearance of the products that we deliver.
Under the Consumer Code (Leg. Decree 206/05), OIP srl customers have a right of withdrawal: you may return the products that you have bought within 10 working days of receiving them. This right does not apply to products that, because of their nature, cannot be re-shipped.

6. APPLICABLE LAW AND COMPETENT COURT
All contracts entered into on the basis of these general conditions are governed by Italian law.
For any dispute that may arise about these general conditions or about the contracts entered into under these conditions – except where article 14 of Legislative Decree no. 185 of 22 May 1999 applies – the sole competent court will be the court of Brescia.
PRIVACY POLICY STATEMENT UNDER LEG. DECREE No. 196/2003
In accordance with article13 of Leg. Decree no. 196/2003, we inform you that the company OIP srl will use the information that you have provided in accordance with the personal-data-protection laws.You do not have to provide your information, but without it, we shall not be able to fulfil the contract.
The personal data that you provide is gathered electronically and processed via electronic and other means directly by us and/or by third parties that we appoint, for the following purposes:
- to fulfil the contract
- to fulfil our accounting, administrative and tax obligations
- for statistical purposes
- for advertising and marketing.
In any case, your data will not be disclosed (or sold to third parties); it will be used within OIP srl only.
Under article7 of Leg. Decree no. 196/2003, you have the right at any time to be told by the Data supervisor how your data is being processed and for what purposes. You are also entitled:
1) to have confirmation that data is being held and where it came from: you have the right to see this data;
2) to know who are the Data controller, the Data supervisors and the parties or types of party to which your data may be disclosed or to whose attention it may come as designated managers or operatives;
3) to have your data updated, corrected and added to;
4) to have your data deleted, anonymised or frozen where it has been handled illegally;
5) to have confirmation that actions taken under points 3 and 4 have been notified to those parties to whom the data has been disclosed, except where such notification is impossible or would require an effort that is clearly disproportionate to the safeguarded right;
6) to withhold your permission (with good reason) for your data to be processed, even where the data is relevant to the purposes for which it has been collected.

7. RETURNS AND REFUNDS
In accordance with the legal provisions in force in Italy, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the period of 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products. In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day term begins on the date of receipt of the last product.
The buyer who intends to exercise the right of withdrawal must communicate it to OIP S.R.L. by explicit declaration, which can be sent by registered letter with return receipt or by accessing the section: Ecommerce Disclosure - Right of withdrawal on the OIP S.R.L. with the creation of a practice.
The purchaser must exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will reimburse the amount of products subject to withdrawal within a maximum period of 14 days, including any shipping costs.
As foreseen by the art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the reimbursement until receipt of the goods or until the demonstration by the buyer of having returned the goods.
The site will reimburse using the same payment method chosen by the buyer at the time of purchase. In the case of payment made by bank transfer, and if the purchaser intends to exercise his right of withdrawal, he will have to provide the bank details: IBAN, SWIFT and BIC needed to make the repayment.
8. Fine and rare wines aged over 20 years
The rare and precious wines are stored in a vault at controlled light and temperature, once sold they are transported for delivery and in total safety; the complexity of the bottles and their rarity cannot be returned and reimbursed for these bottles for purely subjective reasons, but exclusively for any damage that can be verified during delivery and transport.
9. Taxation and Excise
When placing an order, the customer must declare his tax data in order to proceed with correct invoicing. He must state whether he is purchasing as a private individual or company in order to receive a correct electronic invoice. If the customer is an international customer belonging to the European Union, he must declare if he is a private individual in order to receive a regular sales receipt and must declare if he is a company in order to receive an invoice excluding VAT. For purchases outside the European Community, any customs costs shall be borne by the customer. OIP SRL has numerous European VAT numbers and makes regular tax declarations and payments. In addition, OIP SRL has numerous tax representatives through which it acquits the payment of excise duties.
